Welcome to Wicked Slabz. These Terms and Conditions ("Terms") govern your access to and use of our website wickedslabz.com (the "Site") and any purchases you make from us ("Wicked Slabz," "we," "us," or "our"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase. By placing an order, you represent that you meet this requirement and that the information you provide is accurate and complete. Minors may use the Site only with the involvement of a parent or legal guardian.

2. Our Products

  • We sell graded sports trading cards ("slabs") encased in protective holders and graded by independent third parties (PSA / BGS).
  • Each slab is a unique, one-of-a-kind item. Product listings show the actual card you will receive, including its assigned grade and grading company.
  • We make every effort to display colors, images, and descriptions accurately, but we cannot guarantee that your device displays them perfectly. Minor variations in appearance are not defects.
  • Grades are assigned by third-party graders, not by Wicked Slabz. We represent grades accurately but do not control, set, or guarantee any third-party grade.

3. The Offer (Free Bonus Slabs)

We run a promotion in which qualifying purchases receive additional slabs at no charge ("Free Bonus Slabs"). By participating, you understand and agree that:

  • Bonus tiers are based on the number of slabs and/or order total at checkout (for example, buy 4 slabs / spend $100 and receive $40 in bonus slabs), as described on our Offer page.
  • Bonus slabs are selected by Wicked Slabz and cannot be hand-picked, exchanged for cash, or substituted unless we choose to do so.
  • Free Bonus Slabs have no independent cash value and are governed by our Refund Policy, including the rules on returns that drop an order below a qualifying tier.
  • We may modify, suspend, or end the Offer at any time. Offer terms in effect at the time of your order apply to that order.

4. Pricing and Availability

  • All prices are listed in U.S. Dollars (USD) unless stated otherwise and are subject to change without notice.
  • Inventory is limited and items are unique; an item may sell out before your order is completed.
  • We strive for accuracy, but if a product is listed with an incorrect price or description due to a typographical or system error, we reserve the right to cancel the order and refund any amount charged, even after an order confirmation has been sent.

5. Orders and Acceptance

  • Your order is an offer to purchase. Order confirmation acknowledges receipt of your order but does not constitute our acceptance.
  • We reserve the right to refuse, limit, or cancel any order for any reason, including suspected fraud, errors, or stock issues. If we cancel an order you've paid for, we'll refund you.

6. Payment

  • We accept Credit Card, PayPal, Apple Pay, and Cash App, as shown at checkout.
  • Payments are processed by third-party payment processors. We do not store full payment card details. Your use of these payment methods is also subject to the processor's own terms and privacy policies.
  • By submitting payment information, you represent that you are authorized to use the chosen payment method.

7. Shipping

Shipping is handled via USPS and governed by our Shipping Policy, which is incorporated into these Terms. Risk of loss passes to you upon delivery by the carrier, except as otherwise stated in our Shipping Policy.

8. Returns and Refunds

Returns and refunds are governed by our Refund Policy, which is incorporated into these Terms.

9. Accounts

If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

10. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms;
  • Resell, scrape, or systematically extract data or inventory from the Site without permission;
  • Attempt to gain unauthorized access to the Site, other accounts, or our systems;
  • Interfere with the Site's operation, introduce malware, or place fraudulent orders;
  • Use bots or automated tools to acquire inventory or abuse the Offer.

11. Intellectual Property

The Site and its content — including the Wicked Slabz name, logo, text, graphics, and design — are owned by or licensed to us and protected by intellectual property laws. You may not copy, reproduce, or use our content without our written permission.

12. Third-Party Trademarks

PSA, BGS (Beckett), player names, team names, leagues, and any manufacturer marks referenced on the Site are the property of their respective owners. Wicked Slabz is not affiliated with, endorsed by, or sponsored by these parties. References are for identification and descriptive purposes only.

13. Collectibles Not Investments

Trading cards are collectibles, not financial instruments. Nothing on the Site is investment, financial, or tax advice. The value of collectibles can rise or fall, and we make no representation or guarantee regarding future value, resale price, or appreciation of any item.

14. Disclaimer of Warranties

The Site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Nothing in this section limits any non-waivable rights you have under applicable consumer protection law.

15. Limitation of Liability

To the fullest extent permitted by law, Wicked Slabz and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, arising from your use of the Site or any product. Our total liability for any claim related to a product will not exceed the amount you paid for that product.

16. Indemnification

You agree to indemnify and hold harmless Wicked Slabz and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Site.

17. Changes to These Terms

We may update these Terms at any time. The "Last updated" date reflects the most recent version. Changes take effect when posted. Your continued use of the Site after changes constitutes acceptance.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
